HOA Fees Are Rising — But What Are Your Rights as a Homeowner?

HOA fees are going up across the country, and for many homeowners, the increases are not small. In some communities, dues have doubled—or worse—seem to come out of nowhere.

We’re seeing this come up more and more across communities, and the questions tend to follow a pattern.

What can homeowners actually do about it?

More specifically:

  • Can you challenge a dues increase?
  • Can you find out who isn’t paying?
  • Can you refuse to pay if the HOA is mismanaged?

Here’s what you need to know.

Why HOA Fees Keep Increasing

There isn’t just one reason—and in most cases, it’s a combination of factors.

In our prior breakdown on rising HOA fees, we outlined the main drivers: inflation, insurance increases, new safety requirements, and underfunded reserves finally catching up.

👉 Navigating Rising HOA Fees: Strategies for Financial Stability

What we consistently see in real-world communities is that these issues don’t develop overnight. They build over time—often years—until a point where the association has no choice but to raise dues or impose special assessments.

That’s why some increases feel sudden, even though the underlying problems have been there for a while.

Some increases are unavoidable. But how they are handled still matters.

Can an HOA Just Raise Dues Whenever It Wants?

Not exactly.

Most associations have the authority to increase dues, but only within limits set by their governing documents. If an increase exceeds those limits, it often requires approval from the membership.

The key point is this:

👉 There is no one-size-fits-all answer

It depends entirely on the CC&Rs and bylaws for that specific community.

In practice, many homeowners don’t look at these documents until after the increase has already taken effect, which is when options become more limited.

Can You See Who Is Not Paying Their HOA Dues?

This is one of the most common questions—and one of the most misunderstood.

In most associations, members have the right to review financial records. That typically includes budgets, financial statements, and in many cases, delinquency summaries.

However, whether you can see exactly who is not paying often depends on state law and how the association handles member privacy.

What matters more from a practical standpoint is the impact.

When delinquencies increase, it affects:

  • the association’s cash flow
  • its ability to fund reserves
  • and ultimately, the financial burden on paying members

This is often one of the hidden drivers behind rising dues.

Can You Refuse to Pay HOA Dues?

This is where homeowners tend to make decisions that create bigger problems.

We’ve addressed this directly before, and it’s worth repeating:

👉 Nonpayment of HOA Dues is Not the Answer to a Mismanaged Association

Even when an HOA is failing to meet its obligations, withholding dues does not fix the issue—and typically makes things worse.

From what we’ve seen across many situations, the consequences can escalate quickly:

  • late fees and interest
  • collections and credit impact
  • liens against the property
  • and in some cases, foreclosure proceedings

The obligation to pay dues is separate from the association’s performance, even when that feels counterintuitive.

So What Can Homeowners Do?

This is where homeowners actually have leverage—but it requires being proactive.

Instead of reacting after an increase is imposed, the more effective approach is to stay involved before decisions are finalized.

That includes:

  • reviewing governing documents to understand limits on increases
  • attending meetings where budgets are discussed
  • asking questions about reserve funding and long-term planning
  • requesting financial records when something doesn’t add up
  • participating in elections or board decisions

The most important factor is understanding how the numbers are being calculated.

Because once a budget is approved, there are far fewer options to challenge it.

The Bigger Issue

What we consistently see is not just rising fees—but a lack of clarity around them.

Homeowners are often dealing with increases without having:

  • a clear explanation of the underlying costs
  • access to organized financial information
  • or a practical understanding of what their rights actually are

That gap is where frustration builds.

If You Want to Understand What’s Actually Going On

If you’re trying to make sense of:

  • dues increases
  • HOA financials
  • or your rights as a homeowner

having clear, reliable information makes a difference.

Bottom Line

HOA fees are rising. That part is real.

But whether those increases are justified—and what you can do about them—comes down to understanding your governing documents, your association’s financial position, and how decisions are being made.

And in most cases, that understanding comes too late—after the increase has already happened.
