Florida state statutes mandate that residential homeowners’ associations follow certain procedures in connection with the conducting of membership meetings and the election of the directors of the association by the members. The statutes and/or governing documents also mandate procedures to be followed in conducting the votes/elections by the members and those that are to be followed after the vote or election takes place.
This Guide describes the steps that should be followed by a Florida residential homeowners’ association in order to conduct membership voting and elections and the process for challenging a vote or election that has not been properly conducted. The information contained in this Guide does not apply to condominium, timeshare, or mobile home associations, or to associations for communities in Florida that are composed of property that is primarily intended for commercial, industrial, or other nonresidential use. Throughout this Guide there are references to Florida state statutes and rules concerning elections, copies of which are contained in Appendix A.
