This case concerns a dispute between Dr. Lee, a homeowner, and her homeowners association over alleged covenant violations. The issue arose when the HOA determined that Dr. Lee’s driveway was stained and required repairs. After multiple warnings and extensions, the HOA imposed escalating fines for her non-compliance, ultimately leading to legal action.
The Circuit Court ruled in favor of the HOA, ordering Dr. Lee to pay $3,300 in fines and $34,575 in attorneys’ fees. Dr. Lee, representing herself for most of the proceedings, appealed the decision, arguing that the trial was marred by fraud, procedural unfairness, and due process violations. However, the Appellate Court upheld the ruling, rejecting her claims of “fraud on the court” and procedural misconduct.
