Court Holds HOA Had No Discretion to Withhold Records Owners Were Entitled to Inspect

Summary
This case involved a records dispute between two homeowners and their homeowners association. The homeowners were concerned that the association was not properly maintaining common areas and was not enforcing the governing documents against other owners. To investigate those concerns, they submitted a written request for association records, including insurance policies and financial records showing expenditures for maintenance and repairs.
The association produced some records, but not all of the requested records. After additional attempts to obtain the missing documents were unsuccessful, the homeowners filed a lawsuit seeking a court order requiring the association to produce the records, statutory damages, and attorney’s fees under Florida law.
The trial court ruled in favor of the association, finding that it had provided “sufficient” documents in response to the request. The appellate court reversed, holding that “sufficient” compliance was not enough. Under Florida’s HOA records statute, the association’s duties were mandatory.
